
Ordinance/MTP No. 313, of 09/22/2021, provides for the implementation of the Professional Social Security Profile (PPP) in electronic means, through eSocial.
THE MINISTER OF LABOR AND SOCIAL SECURITY, in the use of the attributions conferred on him by art. 87, sole paragraph, item II, of the Constitution and in view of the provisions of art. 68, §§ 3 and 8 of the Social Security Regulation, approved by Decree No. 3,048, of May 6, 1999, and amended by Decree No. 10,410, of June 30, 2020, resolves:
Art. 1 From the beginning of the obligatoriness of Occupational Safety and Health (OSH) events in the Simplified Digital Bookkeeping System of Social Security, Labor and Tax Obligations - eSocial, the Professional Social Security Profile - PPP will be issued exclusively electronically for policyholders of obligated companies.
§ 1 The implementation of the PPP in electronic means will be gradual, according to the implementation schedule of OSH events on eSocial.
§ 2 The guidelines regarding the proper completion in eSocial of the information that make up the PPP are established in the eSocial Guidance Manual (MOS).
Art. 2nd The PPP in electronic means corresponds to the worker's work history from the beginning of the obligatoriness of the OSH events in eSocial, according to the established schedule.
§ 1 The registration of the profession related to the previous period must be done according to the procedure adopted at the time, in a physical environment.
§ 2 For the periods prior to the beginning of the mandatory PPP in electronic means, the obligation to provide the insured person with the PPP in physical means remains.
Art. 3º The information that composes the PPP in electronic means is contained in the model prepared by the National Institute of Social Security - INSS.
Single paragraph. The identification of the worker will occur through the registration number in the Individual Taxpayer Registry - CPF, waiving the indication of other identification documents.
Art. 4 The fulfillment of the obligation to prepare and update the PPP in electronic means occurs through the reception and validation by the national eSocial environment of the information that compose it, sent:
I - by the company, in the case of an insured employee;
II - by the work or production cooperative, in the case of an affiliated cooperative member; It is
III - by the labor management body or by the union of the category, in the case of a temporary worker.
§ 1 The sending of the information that composes the PPP to the national eSocial environment is verified from the successful delivery receipt of the respective events that contain it, observing the rules and deadlines for updating the information.
§ 2 The procedure provided for in the caput represents the fulfillment of the obligation to provide the PPP.
§ 3 The information contained in the electronic PPP will be available to the insured through the digital channels of the INSS.
Art. 5th The consolidated information of the PPP will be made available to the insured by the INSS, based on the data of the link with the company and the events:
I - Work Accident Reports, included in the event 'S-2210 - Work Accident Report';
II - Professiography and Environmental Records, contained in the event 'S-2240 - Environmental Conditions at Work - Harmful Agents'; It is
III - Result of Biological Monitoring, contained in the event 'S-2220 - Monitoring of Worker's Health'.
Art. 6 From its implementation, the PPP in electronic form must be completed for all policyholders, regardless of the company's field of activity and exposure to harmful agents.
Art. 7 It will be up to the INSS to adopt the necessary measures to receive PPP information electronically and to make such information available to the insured person, from the beginning of the obligation of OSH events on eSocial.
Art. 8th Exceptionally, for companies in the first eSocial group, the replacement of physical PPP by electronic PPP will take place on January 3, 2022.
§ 1 The exceptionality provided for in the caput does not exempt the companies of the first group from sending to the eSocial environment the information of the events 'S-2240 - Environmental Conditions at Work - Harmful Agents' and 'S-2220 - Monitoring of Worker's Health' since the beginning of mandatory such events, according to the eSocial implementation schedule.
§ 2 After January 3, 2022, the physical PPP will not be accepted for proof of rights before Social Security for information from that date on the companies in the first group of eSocial, which must be included in the PPP in electronic means.
Art. 9 This Ordinance comes into force on October 1, 2021.
